Welcome to proteinbalance.in (the “Site”), owned and operated by Volt Nutrition Pvt Ltd (“Volt Nutrition,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Site and the purchase of products offered by Protein Balance (trademarked) through the Site.
By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any of these Terms, you must not use this Site.
We reserve the right, in our sole discretion, to modify, alter, or otherwise update these Terms at any time. Any such modifications, alterations, or updates will be effective immediately upon posting on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes.
1. User Eligibility and Account Management
1.1 Eligibility: To use this Site and purchase products, you must be at least eighteen (18) years of age and capable of forming a binding contract under Indian law. The Site is not available to minors or to any users suspended or removed by Volt Nutrition for any reason whatsoever. A minor may use/access the Site under the supervision of an adult parent or legal guardian who agrees to be bound by these Terms. You are prohibited from purchasing any product that is for adult consumption, the sale of which to minors is prohibited. By using the Site, you represent and warrant that you are of legal age to form a binding contract and are not a person barred from receiving services from the Site under applicable laws.
1.2 Account Creation: You may be required to create an account to access certain features or make purchases on the Site. When creating an account, you agree to provide accurate, current, and complete information.
1.3 Account Security: You are solely responsible for maintaining the confidentiality of your account login credentials (username and password) and for all activities that occur under your account. You agree to notify Volt Nutrition immediately of any unauthorized use of your account or any other breach of security. Volt Nutrition will not be liable for any loss or damage arising from your failure to comply with this section. You are prohibited from selling, trading, or otherwise transferring your account to another party or impersonating any other person for the purpose of creating an account with the Site. You are responsible for ensuring that the information provided by you during account creation or purchase is accurate, complete, and up to date.
1.4 Right to Refuse/Terminate Access: Volt Nutrition reserves the right to refuse access to the Site to new users or to terminate access granted to existing users at any time, without notice or liability, for any reason, including if technical problems, irregularities, misuse, or breach of these Terms occurs.
2. Intellectual Property Rights
2.1 Ownership: All material on this Site (“Material”), including but not limited to text, images, illustrations, designs, icons, photographs, video clips, audio clips, graphics, interfaces, and the compilation thereof, as well as the trademarks, logos, and service marks (“Marks”) displayed on the Site, are protected by copyrights and other intellectual property rights. These are either owned and controlled by Volt Nutrition Pvt Ltd or by other parties that have licensed their material to us. The brand name “Protein Balance” and the website “proteinbalance.in” are owned by Volt Nutrition Pvt Ltd.
2.2 Restrictions on Use: Material from the Site or any website owned, operated, licensed, or controlled by us may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without our prior written permission.3 Specifically, you should not attempt to “pass off” any of the Material as your own work.3 Modification of the Material or use of the Material for any other purpose is a violation of our copyrights and other proprietary rights. For purposes of these Terms, the use of any material on any other website or networked computer environment is prohibited.
2.3 Trademark Usage: Users are strictly prohibited from using any Marks displayed on the Site without the express written permission of Volt Nutrition Pvt Ltd or the respective third parties who may own the Marks.
2.4 User-Generated Content: If you submit reviews, feedback, or content (including images, videos, or messages), you grant us the right to use such content on our website and marketing channels.
3. Product Information, Usage, and Disclaimers (Specific to Nutraceuticals)
3.1 Nature of Products: Products offered on the Site by Protein Balance are nutraceuticals and health supplements and are not a substitute for a balanced diet. As per the Food Safety and Standards Authority of India (FSSAI) regulations, these products are classified as “foods” and are intended to provide physiological benefits and help maintain good health.
3.2 Mandatory Disclaimer: Every package of a Protein Balance nutraceutical product, and prominently on the Site where products are displayed, carries the advisory warning: “NOT FOR MEDICINAL USE“.
3.3 Claims Restrictions: Our products are not intended to diagnose, treat, cure, or prevent any disease, nor can they imply such properties through pictures, vignettes, or symbols. Such claims are considered akin to drugs and do not fall under the ambit of FSSAI. Statements related to the body’s structure, function, or general well-being may be allowed only if supported by generally accepted scientific data.
3.4 No Medical Advice: The information provided on this Site, including blogs, articles, guides, and other educational content, is intended for general informational purposes only and should not be considered medical, nutritional, or professional advice. Individual health needs may vary, and users are advised to consult a qualified healthcare professional before making dietary or health-related decisions.
3.5 Usage and Warnings: Users are advised not to exceed the recommended daily usage of any product. The Site and product labels will provide warnings or precautions, known side effects, contraindications, and published product/drug interactions, as applicable. Products must be stored out of reach of children.
3.6 Product Variation: While we strive for accuracy, there may be minor variations in product appearance, packaging, or formulation within FSSAI tolerance limits. Claims are based on scientific data, but individual results may vary. We do not guarantee specific outcomes related to health, fitness, or nutrition.
3.7 FSSAI Compliance: All Protein Balance products comply with FSSAI regulations concerning ingredients, formulation, quality, and labeling, including adherence to the Indian Pharmacopoeia for dosage forms and not exceeding Recommended Dietary Allowances (RDA) specified by the Indian Council of Medical Research (ICMR). Hormones, steroids, and psychotropic substances are strictly prohibited in our products.

4. Order Placement, Payment, Shipping, and Returns
4.1 Order Acceptance: Your placement of an order on the Site constitutes an offer to purchase the products. All orders are subject to acceptance by Volt Nutrition. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or issues identified by our fraud prevention department.
4.2 Payment: We accept various payment methods as indicated on the Site. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge your payment method for the total amount of your order (including any applicable taxes and shipping fees). We will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of the Your ID/password/credit card number/account details number for using the Website.
4.3 Shipping and Delivery:
All deliveries sent to residential or commercial spaces may require a receipt signature for authentication. We take no responsibility for shipment receipt signed by an alternative person other than the person ordering the product or someone appointed by you to receive the order at the delivery address.
Delivery timelines are estimates and may vary due to external factors beyond our control.
4.4 Cancellation, Returns and Refund Policy : Our detailed cancellation, return and refund rn policies are available on the Site and are incorporated herein by reference. We are committed to ensuring full compliance with consumer rights as stipulated by the Consumer Protection Act, 2019, regarding product defects or deficiencies.
4.5 Communication Consent: By placing an order or providing your contact details, you agree to receive transactional communications (such as order confirmations, shipping updates, and support messages) and, where consent is provided, marketing and educational communications via email, SMS, or WhatsApp.
5. Limitation of Liability and Indemnification
5.1 Limitation of Liability: To the fullest extent permissible pursuant to applicable law, neither Volt Nutrition Pvt Ltd nor any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to, or use of, the Material or the Site. Without limiting the foregoing, everything on the Site is provided to you “as is” without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
5.2 Disclaimer of Responsibility: Volt Nutrition shall have absolutely no liability in connection with the services, including without limitation, any liability for damage or injury to you or damage to your computer hardware, data, information, and business resulting from the Material or the lack of information available on the Site. Additionally, we shall have no liability for:
- Any loss or injury caused, in whole or in part, by our actions, omissions, or negligence, in procuring, compiling, or delivering the Material 3;
- Any errors, omissions, or inaccuracies in the Material regardless of how caused, or delays or interruptions in delivery of the Material 3; or
- Any decision made or action taken or not taken in reliance upon the Material furnished at this Site.
5.3 No Warranty on Content: We make no warranty, representation, or guarantee as to the content, sequence, accuracy, timeliness, or completeness of the Material or that the Material may be relied upon for any reason. We make no warranty, representation, or guarantee that the Material will be uninterrupted or error-free or that any defects can be corrected.
5.4 Indemnification: You agree to indemnify, defend, and hold harmless Volt Nutrition Pvt Ltd, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site using your Internet account. This includes claims for infringement of intellectual property rights, defamation, or libel relating to any material or content that you make available or send to the Site.
6. Prohibited User Conduct
You agree not to engage in any of the following prohibited activities:
Unlawful or Harmful Content: Transmitting or sending any material to the Site that is unlawful, harmful (including any virus), threatening, libelous, defamatory, obscene, scandalous, deceptive, fraudulent, tortious, inflammatory, pornographic, indecent, or profane, or any material that could constitute or encourage any such conduct.

Impersonation: Using or impersonating any person or entity, third parties’ likeness, names, and/or properties, or falsely indicating or misrepresenting your affiliation with any person or entity.
Cybercrimes (as per IT Act, 2000):
Tampering with computer source documents by knowingly or intentionally destroying, concealing, or altering computer source code.
Hacking with a computer system, including unauthorized access or destruction of information in a computer resource with intent to cause wrongful loss or damage.
Receiving stolen computer resources.
Fraudulently using another person’s password, digital signature, or other unique identification.
Cheating or scamming others using computer resources, such as creating fake websites to collect personal information or money.
Publishing private images of others without consent.
Engaging in acts of cyber terrorism, such as denying access to authorized personnel to a computer resource or accessing a protected system to threaten India’s unity, integrity, sovereignty, or security.
Interference: Introducing viruses or other malicious software into the system, causing damage to a computer network or database, or preventing an authorized user from accessing the system.
Data Misuse: Accessing, downloading, or copying data without proper authorization, altering or removing information to reduce its value, or stealing or messing with computer program code.
Volt Nutrition may review, edit, or delete materials you or others send to this Site, but are under no obligation to do so and assume no responsibility or liability arising from the material.
7. Governing Law and Dispute Resolution
7.1 Governing Law: This agreement shall be governed by and construed and enforced solely in accordance with the laws of India.
7.2 Jurisdiction: The courts at Bengaluru, India, shall have exclusive jurisdiction in this regard.
7.3 Grievance Redressal: In accordance with the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023, Volt Nutrition is committed to providing a readily available grievance redressal mechanism. You agree to first exhaust our internal grievance redressal mechanisms before escalating any complaints to consumer commissions or the Data Protection Board of India. 7.4 Alternative Dispute Resolution: We encourage alternative dispute resolution methods like mediation for efficient resolution of disputes, aligning with the Consumer Protection Act’s emphasis on simplified dispute resolution.
8. Policy Amendments
Volt Nutrition Pvt Ltd reserves the right to update, change, or modify these Terms & Conditions at any time without prior notification. The updated Terms shall come into force from the date of such update, change, or modification. Your continued use of the Site after any such modifications signifies your consent to such changes and agreement to be legally bound by the same.
9. Severability
If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
10. Entire Agreement
These Terms constitute the entire agreement between the parties relating to the matters contained herein.
